Apple and Eminem settle out of court

Eminem and Apple had a dispute–this was over money and so like most other civil disputes, this was settled out of court.

After a trial that lasted for five days in a Detroit federal court, Apple and Eminem’s publisher, Eight Mile Style came to an agreement to settle the case out of court. However, neither side wants to talk about it.

The dispute was about royalties on 93 songs that Apple has made available for download on its iTunes store after an agreement with Dr. Dre’s Aftermath Records Aftermath Records controls Eminem’s sound recordings.

Eight Mile Style claimed that Apple has infringed upon its copyrighted properties and sought to recover $2.58 million–the amount that Apple has earned from the sale of the songs and an additional $14 million–$150,000 for every instance of infringement.

Eminem was not officially involved in the suite and so didn’t come to the court.

The case was filed in July 2007 and has dragged on till now without any results. Eight Mile Style alleged that Eminem’s songs were being sold without his approval.

Earlier, Eight Mile Style has sued Apple which has used “Lose Yourself” in an iTunes advertisement with authorization from the published. That case was also settled out of court.

Apple’s attorney has revealed that for download Aftermath was receiving 70 cents while Eight Mile Style was receiving 9.1 cents. Additionally, he also stated that Eight Mile Style was cashing its checks amounting to a large amount over the years.
